Acting for Lenders – Tips and Traps

Acting for lenders in residential transactions brings with it a raft of issues and problems. If a lender sustains loss on repossession they are likely to look to the conveyancer to determine whether any liability arises to enable loss to be recovered.

We will examine the basics when acting for lenders along with some of the common problems that can arise when advising the lender on a purchase or remortgage.

Using case studies we will explore problem areas and how to prevent and avoid claims:

• The mortgage deed – what should be reported to the client
• Dealing with searches and due diligence lender requirements

• What causes lender claims
